Mr. Phan Quoc Viet has been fined VND 1 billion by the Kien Giang provincial People's Committee and ordered to address administrative violations in accordance with the rules of Clause 1, Article 105 of the Fisheries Law 2017 and Clause 1, Article 5. No. 42/2019/ND-CP Decree.
Mr. Phan Quoc Viet, 59, of An Binh ward, Rach Gia city, Kien Giang province, was penalized for six administrative violations:
To begin, Mr. Phan Quoc Viet's two fishing boats, KG-95383-TS and KG-94790-TS, exploited fisheries products in Malaysian seas without licenses or authorization, for which the authorities punished him VND 900 million.
Second, the fisherman failed to maintain cruise monitoring equipment for fishing boats with a maximum length of 24m or more when operating at sea. Mr. Phan Quoc Viet's fishing boat KG-95383-TS is the longest at 25.40m. This act resulted in a VND 400 million fine.
Third, he removed the cruise tracking device from the fishing vessel KG-95383-TS without the equipment supplier's or installer's supervision. The violation carries a fine of VND 4 million.
Fourth, he mistyped the registration number of a fishing vessel, resulting in a VND 2.5 million fine (fishing vessel KG-95383-TS was written as KG-95186-TS).
Fifth, he failed to maintain cruise monitoring equipment for fishing boats with a maximum length of 15m to less than 24m while they were at sea (fishing vessel KG-94790-TS with the largest length 21, 98m). This act resulted in a VND 25 million fine.
Sixth, the fishing vessel KG-94790-TS's cruise monitoring system was removed without the consent of the equipment provider and installation, leading to a VND 4 million in charge.
Additionally, authorities sanctioned Mr. Phan Quoc Viet by seizing his two fishing boats and ordering him to pay the whole cost of transporting the fishermen on the two fishing boats. This is presently being arrested and returned to Malaysia by the Malaysian side.
