Decree No. 03/2022/ND-CP specifies administrative violations, sanctioning forms, levels and remedial measures; competence to make report and sanction for acts of administrative violations in the field of natural disaster prevention and control, irrigation, dike.
The Decree stipulates that the maximum fine for the field of natural disaster prevention and control is VND 50 million, dike is VND 100 million, irrigation is VND 250 million.
The Decree stipulates a fine of between VND 3 - 5 million for acts of arbitrarily operating or obstructing the operation of embankment works, anti-erosion works, anti- land subsidence works, anti-flash flood works and disaster warning works.
Fine in range of VND 6 - 8 million will be imposed for anchoring, stopping or parking at the wrong place of ships and other vehicles entering the natural disaster prevention and control works.
Acts of intentionally using a natural disaster prevention and control works for wrong purposes will be subject to a fine of between VND 8 - 15 million.
Acts of building works infringing upon embankment works, anti-slide works, anti-land subsidence works, anti-flash flood works, disaster warning works but not yet serious enough to be prosecuted for penal liability will be fined up to VND 50 million.
For violation of regulations on rescue in natural disaster prevention and control, Decree stipulates for acts of knowing that other people are in distress but failing to promptly notify competent forces to come to rescue at sea, lagoon, river, stream, pond, lake, canal will be fined from VND 5 to 10 million.
A fine ranging from VND 10 to 20 million will be imposed for failing to save lives or vehicles in distress at sea, lagoon, lagoon, river, stream, pond, lake, canal but not yet to the extent of criminal prosecution, except case of ineligibility or majeure.
A fine of between VND 20 - 40 million will be imposed for requesting rescue but failing to cooperate when the rescue forces approach.
Acts of falsely reporting distress to request rescue for vehicles and boats operating at sea, on river or on lake, will be fined from VND 30 to 50 million.
In the field of irrigation, the Decree stipulates that the act of dumping garbage and waste within the protection area of irrigation works is fined up to VND 80 million.
A fine of between VND 80 - 100 million will be imposed for blasting and other explosive activities without a license to operate within the protection area of irrigation works but not to the extent of criminal prosecution.
All above penalties apply to individuals. The fine for organizations is 2 times of that for individuals.
